5. Orders & Acceptance

Placing an order constitutes an offer to purchase. Nooraliya reserves the right to accept, reject, or cancel any order at our sole discretion—even after payment is processed—due to inventory errors, fraud suspicion, or other legitimate reasons.

Your order is confirmed only when we send a shipping confirmation email. We will notify you if we cancel your order and issue a full refund if payment was collected.

All purchases are for personal, non-commercial use only. You agree not to resell, redistribute, or commercially exploit any products purchased from Nooraliya without our prior written consent.

6. Pricing & Payment

All prices are listed in the currency selected at checkout and are subject to change without notice. Prices do not include:

  • Import duties, taxes, or customs fees (your responsibility);
  • Shipping and handling charges (shown at checkout).

You agree to provide accurate, complete, and current billing and payment information. You authorize us to charge your selected payment method for the total amount due, including applicable taxes and fees.

You represent that:

  • You are authorized to use the payment method provided;
  • All information is true and correct;
  • You will pay all charges incurred.

7. Shipping & Delivery

Estimated delivery times are provided for reference only and are not guaranteed. Delays caused by carriers, customs clearance, natural disasters, or other events beyond our control are not our responsibility.

Title and risk of loss pass to you upon delivery to the carrier.

8. Intellectual Property

All content on the Site—including text, graphics, logos, product designs, and the overall look and feel—is the property of Nooraliya or its licensors and is protected by copyright, trademark, and other intellectual property laws.

“Nooraliya” and related logos are trademarks of Nooraliya. Shopify is a trademark of Shopify Inc. All third-party marks belong to their respective owners.

The Site may contain links to third-party websites or integrate third-party services (e.g., payment gateways, social media). We do not control or endorse these sites and are not responsible for their content, privacy practices, or availability. Use them at your own risk.

10. Relationship with Shopify

Nooraliya operates on the Shopify platform. However, all transactions are between you and Nooraliya. Shopify is not a party to your purchase and bears no liability for product quality, delivery, or disputes. You hereby release Shopify and its affiliates from all claims related to your use of our Services.

11. Privacy & Data Use

Your personal data is processed in accordance with our Privacy Policy. Because we use Shopify, your data may be transferred to and processed in countries outside your jurisdiction (including the United States). By using our Services, you consent to such transfers.

If you are in the EU/UK, our legal basis for processing includes:

THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Some jurisdictions do not allow the exclusion of implied warranties, so this disclaimer may not apply to you.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOORALIYA, ITS AFFILIATES, AND SERVICE PROVIDERS (INCLUDING SHOPIFY) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO NOORALIYA IN THE PAST SIX (6) MONTHS.

18. Indemnification

You agree to defend, indemnify, and hold harmless Nooraliya, Shopify, and their affiliates from any claims, damages, or expenses (including attorneys’ fees) arising from:

  • Your breach of these Terms;
  • Your violation of law or third-party rights;
  • Your misuse of the Services or products.

We will notify you of any claim and may participate in its defense at your expense.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the People’s Republic of China, without regard to conflict of law principles. Any dispute shall be subject to the exclusive jurisdiction of the courts in Yiwu City, Zhejiang Province, China.

However, this choice of law and jurisdiction does not override your mandatory consumer rights under the laws of your country of residence (e.g., EU consumer protections, U.S. state laws).

20. General Provisions

  • Severability: If any provision is unenforceable, the rest remain valid.
  • Waiver: Our failure to enforce a right is not a waiver.
  • Assignment: You may not assign these Terms. We may assign them without notice.
  • Entire Agreement: These Terms, along with our Privacy and Refund Policies, constitute the full agreement between us.
  • Amendments: We may update these Terms at any time. Continued use after changes constitutes acceptance.
  • Headings: Section titles are for convenience only and do not affect interpretation.
